Patent Filing Fees to Increase in 2025 Patent Filing Fees to Increase in 2025

United States Patent and Trademark Office (USPTO) patent filing fees are rising significantly in 2025. For example, utility patent filing fees will increase approximately 10%, design patent application fees will increase by 25%, and design patent issue fees will increase by 76%. There is also a significant new surcharge for any continuation applications filed over 5 years after the earliest priority benefit date and over 8 years after the priority date.   

It may be beneficial to file patent applications in 2024 before these new fees take effect.
