Best & Flanagan Attorneys Secure Decision in Eighth Circuit

On Monday, April 29, the U.S. Court of Appeals for the Eighth Circuit affirmed a decision from the U.S. District Court for the District of Minnesota regarding alleged violations of the Americans with Disabilities Act (“ADA”).
 
Attorneys Ashleigh Leitch, Ted Sheu, and Lauren Clements successfully argued on behalf of a restaurant and real property owner that changes made to the restaurant parking lot had remedied the alleged deficiencies claimed by the appellant. In December 2017, the district court dismissed the complaint as moot and denied the plaintiff’s motion for leave to amend the complaint. On appeal, the Eighth Circuit affirmed the decision to dismiss for lack of jurisdiction.
