Kyle Hardwick is a construction and energy law attorney and leads Best & Flanagan’s Litigation and Construction Law groups. His unique “hybrid” practice focuses on drafting and negotiating contracts for clients on complex, cutting-edge projects and resolving claims when disputes arise.

Much of Kyle’s practice involves advising clients on renewable energy and infrastructure projects. He regularly drafts and negotiates EPC, design-build, and master subcontract agreements for clients working on solar farms, battery energy storage systems, and data processing facilities. Kyle also has extensive experience working on large-scale utility projects, a specialized area where the contractual stakes and regulatory environment are unlike most construction work. His energy practice extends to projects across the country, where he counsels clients on contract structures, project risks, potential claims, and early claim resolution.

Beyond his energy practice, Kyle represents owners, developers, general contractors, and subcontractors across a wide range of construction and real estate projects — from senior living facilities to high-rise apartments and condos, to bridges and roads, to manufacturing facilities, and almost everything in between. He has significant experience advising contractors on public procurement and public bidding matters, where the stakes are high and the deadlines are tight. Kyle is also a “go-to” resource for construction clients and practitioners alike on MnOSHA enforcement actions and complex mechanic’s lien disputes.

Kyle’s litigation practice includes both sides of the table and he has taken matters to trial (jury and bench), AAA and ICC arbitrations, and appeals in multiple state supreme courts and federal circuit courts.

  • Kyle played NCAA Division I hockey at Bemidji State University from 2006-2010. During his time at Bemidji State, Kyle played in two national tournaments, including the 2009 Frozen Four in Washington, D.C. Kyle was elected team captain by his teammates during his senior year.
