As a seasoned attorney, I believe that being prepared and creative in the courts and responsive to clients are key to a successful outcome.
Barbara Ross is an effective trial and appellate attorney who provides her clients with the benefit of twenty-five years of experience in the law. Barbara has won every appeal that she has handled during her career. She concentrates her practice on condemnation/eminent domain, real estate litigation, insurance coverage, and debtor/creditor litigation.
Barbara has extensive experience in successfully handling eminent domain cases for both condemning authorities and landowners, and in litigation involving collection and mortgage foreclosures, title issues, fraud and misrepresentation, boundary disputes, leasing disputes, mechanics lien actions, contract for deed cancellations, partition actions, and real estate contract disputes.
She represents insurance carriers and policyholders in insurance coverage cases, providing to clients courtroom expertise and insight from her work in the insurance industry.
Experience
- In Court of Appeals for the Eight Circuit and in the Bankruptcy Appellate Panel for the Eight Circuit – obtained decisions in favor of a bankruptcy trustee client, as a statutory bone fide purchaser, avoiding a mortgage lien.
- In the Minnesota Supreme Court – the Court issued a decision in favor of a banking client holding a mortgage valid under Minnesota Statutes, Ch. 287.
- In Minnesota Court of Appeals – represented a government entity in defending against a landowner inverse condemnation action, the Court dismissed the inverse condemnation action in a decision with statewide impact for condemning authorities.
- In Minnesota Court of Appeals – decision in favor of a property owner client ordering a soil and water conservation district to approve the client’s wetland replacement application.
- In Minnesota State Court – represented insurance policyholder, resulted in summary judgment in favor of the insured client ordering the insurance company to defend against a defamation claim, resulted in settlement in excess of $1.4 million net to client.
- In Minnesota State Court – tried a quiet title action in which the trial court ruled in favor of our property owner client and dismissed an adverse possession claim.
- Pursued and obtained insurance coverage under a directors’ and officers’ policy for a client that was the subject of an investigation by the Federal Deposit Insurance Corporation.
- Pursued and obtained insurance coverage for business owner client for defense against a copyright infringement claim.
